The October 2025 amendments to O.Reg 406/19 have introduced critical flexibility for the construction and development sectors. Here are some of the more notable changes consultants should be aware of:
โข ๐๐ฎ๐ป๐ฑ๐ณ๐ถ๐น๐น ๐ฅ๐ฒ๐๐๐ฟ๐ถ๐ฐ๐๐ถ๐ผ๐ป ๐๐ฒ๐น๐ฎ๐: The deadline for the restriction on depositing โcleanerโ excess soil (soil meeting Table 2.1) at landfills has been postponed from January 1, 2025, to January 1, 2027. This provides the industry with a crucial two-year extension to adapt.
โข ๐๐ด๐ด๐ฟ๐ฒ๐ด๐ฎ๐๐ฒ ๐ฅ๐ฒ๐๐๐ฒ ๐๐ฒ๐ฝ๐ผ๐๐ ๐๐ ๐ฒ๐บ๐ฝ๐๐ถ๐ผ๐ป: Facilities that accept excess soil primarily for the purpose of producing and storing recycled engineered aggregate and then reuse them are now conditionally exempt from needing a waste Environmental Compliance Approval (ECA). This exemption applies if they meet specific criteria, including registering the site and having oversight from a Qualified Person (QP).
โข ๐ฆ๐๐ฟ๐ฒ๐ฎ๐บ๐น๐ถ๐ป๐ฒ๐ฑ ๐๐ป๐ณ๐ฟ๐ฎ๐๐๐ฟ๐๐ฐ๐๐๐ฟ๐ฒ ๐ฃ๐ฟ๐ผ๐ท๐ฒ๐ฐ๐ ๐ง๐ฟ๐ฎ๐ป๐๐ณ๐ฒ๐ฟ๐: Soil moved between separate infrastructure projects (e.g., from one road construction site to another) under the same project leader or public bodies is now subject to reduced administrative and planning requirements. In these specific scenarios, the soil is not designated as waste, drastically simplifying the process.
โข ๐ฆ๐ช๐ ๐ฃ ๐ฆ๐ฒ๐ฑ๐ถ๐บ๐ฒ๐ป๐ ๐ฎ๐ป๐ฑ ๐๐๐ฝ๐ต๐ฎ๐น๐-๐๐บ๐ฝ๐ฎ๐ฐ๐๐ฒ๐ฑ ๐ฆ๐ผ๐ถ๐น ๐๐น๐ฒ๐ ๐ถ๐ฏ๐ถ๐น๐ถ๐๐: New provisions allow for the more straightforward reuse of stormwater management pond (SWMP) sediment and asphalt-impacted soil. For SWMP sediment, in-situ sampling is now permitted, removing the requirement to stockpile the material before testing.
